§ 1 Scope and contracting party

(1) These terms apply to the use of the platform Astro2Match by registered users.

(2) Your contracting party is:

(3) Deviating terms of the user only apply if the operator expressly agrees to them.

§ 2 Registration, minimum age, e-mail confirmation and type of use

(1) Only persons aged 18 or over may use the platform. By registering, the user confirms that they are of age.

(2) Registration requires truthful information, in particular an e-mail address, profile details and the data needed for matching.

(3) The e-mail address must be verified via a confirmation link. Without a confirmed e-mail address some functions may be restricted. Confirmation e-mails can be requested again; depending on the e-mail program they may end up in the spam or promotions folder.

(4) During setup the user chooses what they want to use Astro2Match for: dating, astrology or both. Anyone who chooses astrology only does not take part in partner matching, is not shown to other users as a partner suggestion and does not have to enter search criteria. The choice can be changed in the profile at any time.

(5) Taking part in partner matching (dating or both) requires explicit consent to the processing of the information on partner preference and the gender sought (see privacy policy). Without this consent the account remains usable for the astrology area.

§ 3 Services and package model

Astro2Match offers a tiered package model. The specific activation is technically controlled by the package and feature rights stored in the customer account.

The current prices, terms and scope of the packages are shown in the price overview on Astro2Match and in the booking process. All prices shown are final prices. The operator is a small business within the meaning of § 19 of the German VAT Act (UStG); therefore no VAT is charged or shown.

(2) The operator may temporarily restrict individual functions for reasons of security, maintenance or moderation; no particular success or number of matches is owed.

§ 3a Conclusion of contract, booking process and language

(1) Free registration only creates a free user account. A paid contract for a package is only concluded when the user selects a paid package in the booking process, confirms the contract data shown and the payment or booking is completed successfully.

(2) Before a paid booking is completed, the essential contract data is shown, in particular package, scope of services, term, final price, any credits or differences and the chosen payment method. The information shown in the booking process at the time of booking is decisive.

(3) The user can correct input errors before completing the booking or cancel the booking process. Merely displaying packages or prices does not constitute a binding offer by the user.

(4) After a successful booking the package is activated in the customer account. Activation can take place immediately once the payment has been processed successfully or the operator confirms the activation.

(5) The contract language is German. Other language versions are provided for convenience; in case of discrepancies the German version prevails.

§ 3b Founder phase

(1) The founder phase runs until 1 December 2026. During this time paid packages cannot be booked yet and no costs are incurred.

(2) During the founder phase dating is free: if two members show mutual interest, a free chat (founder chat) is unlocked for this pair. A founder chat once unlocked remains available to this pair after the founder phase. In the astrology area six readings are free during the founder phase.

(3) After the founder phase the package model under § 3 applies. There is no automatic switch to a paid plan: the account continues as Free unless the user books a package. The operator may extend the founder phase; a shortening will be announced in good time.

§ 4 Term, package changes and downgrade (no subscription)

(1) Paid packages run for 30 days unless something different is shown in the booking process.

(2) There is no subscription and no automatic renewal. The package ends automatically when the term expires; no cancellation is required. Afterwards the account continues free of charge as Free; profile, details and matches are kept. A further term only arises if the user books again.

(3) If the user adds the other single package during a running term (Dating to Astro or Astro to Dating), the account is switched to Both. The unused remaining term of the previous package is credited, so only the difference is due. The booking process shows the calculated amount before payment.

(4) A switch to a smaller package or back to Free takes effect at the end of the term already paid for. Time already paid for is not lost; no pro-rata refund is made unless required by law.

(5) The display in the customer account is decisive as to which package is currently active and until when the current activation runs.

§ 5 Payment, invoices and external payment providers

(1) Payments can be made using the payment methods offered at checkout, in particular card payment via Stripe or PayPal, depending on activation.

(2) Before payment, package, price, term, credit/difference and customer data are shown. Missing customer data must be added before payment.

(3) After a successful order an invoice is created and provided in the customer account. Invoice data relevant for tax purposes is stored in accordance with statutory retention obligations.

§ 6 Withdrawal, digital activation and customer-account procedure

(1) Consumers generally have a statutory right of withdrawal of 14 days from conclusion of a paid distance contract, unless the right of withdrawal is excluded or expires under the statutory rules.

(2) Astro2Match provides digital services. Depending on the package these include in particular contact and messaging functions, gallery and profile activations, astrology readings, match evaluations, partner comparisons, synastry, composite, forecasts, transits and other functions.

(3) Paid packages can be activated immediately after successful payment if the user expressly requests at checkout that Astro2Match begins performing the contract before the withdrawal period expires, and confirms that they are aware that their right of withdrawal may expire in whole or in part under the statutory conditions once the digital service has begun.

(4) When examining a withdrawal, Astro2Match takes into account in particular whether the package has already been activated, whether paid functions have been actively used and whether the required confirmations were given at checkout. Active use of contact and messaging functions is especially relevant, e.g. when the user writes messages after booking. Merely receiving a message or the technical activation alone is not treated as actively writing.

(5) The withdrawal should preferably be submitted via the area “Withdrawal, pause & cancellation” in the customer account, where existing contract data (user ID, package, booking date, term, payment status, invoice reference, usage status) can be taken into account automatically.

(6) Alternatively, the withdrawal can be declared by a clear statement by e-mail to widerruf@astro2match.de. To allow quick assignment, the e-mail should contain the registered e-mail address, the username or user ID and the package concerned.

(7) The examination may lead in particular to approval, rejection, partial refund, downgrade to Free, pausing or manual review, based on the statutory requirements, the booking data, the activation, the active use of digital services and the confirmations given at checkout. The full withdrawal notice is attached as Annex 1.

§ 7 User obligations, contact filter and moderation

(1) Users undertake to behave respectfully, honestly and lawfully. Prohibited are in particular insults, harassment, bullying, threats, spam, fraud attempts, fake profiles, sexual harassment, identity misuse and circumventing package limits.

(2) Racist, antisemitic, discriminatory, inhuman, right-wing extremist, extremist, inciting, violence-glorifying or other hateful content is also prohibited. This applies to profile texts, photos, messages, usernames, hidden hints, links and any other use of the platform.

(3) Advertising, self-promotion, affiliate or referral links, influencer content, paid or unpaid advertising, mass advertising and commercial contact are prohibited without the operator’s prior consent. Where advertising is permitted in an individual case, it must be clearly, truthfully and lawfully labelled as advertising.

(4) Astro2Match may use automatic filters to detect and block phone numbers, e-mail addresses, references to external messengers, offensive or dangerous content, spam or circumvention attempts, or to submit them to moderation.

(5) The operator may review and remove content, warn users, restrict functions or suspend accounts temporarily or permanently if there are violations or a justified suspicion.

(6) Only users who have uploaded a real profile photo of themselves can write to other members. This way everyone can see who they are writing with.

§ 8 Photos, gallery, profile content and review

(1) Uploaded photos must show the user themselves and must not infringe third-party rights. Prohibited are in particular fake photos, offensive content, violence, hate content, advertising, logos or other persons without permission.

(2) Profile and gallery photos are reviewed by the operator before publication. Until approval, other members see the note “Photo under review” instead of the photo. Members who have not uploaded a photo yet appear with the note “Photo coming soon”. Rejected photos are not shown.

(3) The approved main profile photo is clearly visible to all members. The additional gallery (further photos) is reserved for the Dating and Both packages.

§ 8a Copyright and rights of use

(1) Texts, designs, logos, graphics, layouts, horoscope and matching evaluations, database structures, software components and other content of Astro2Match are, insofar as legally protected, the property of the operator or are used with the appropriate authorisation.

(2) Copying, publishing, passing on, editing, automated scraping, commercial use or any other use of Astro2Match content outside the intended use of the platform is not permitted without the operator’s prior consent.

(3) Users generally retain the rights to the profile photos, texts and other content they upload. However, they grant the operator the rights of use required to display, technically process, moderate and provide the platform.

(4) Users may only upload or publish content for which they hold the necessary rights and which does not infringe third-party rights.

§ 8b Voluntary identity check

(1) Users can voluntarily have their identity confirmed by uploading a photo of their identity card or passport. The operator compares the document with the profile photo and profile details.

(2) After the check – whether approved or rejected – the document photo is irrevocably deleted. Only the result is stored. After approval other members see the note “Identity confirmed”.

(3) If the check shows that the user is a minor, the account is suspended.

§ 9 Messages, system messages, archiving and deleting

(1) The message box is used for internal communication between users and for system messages from Astro2Match.

(2) Users can archive, restore or remove conversations from their own view. Deleting from one’s own view does not necessarily delete the conversation partner’s copy and does not replace a statutory deletion under data protection law.

(3) System messages may contain information on registration, security, packages or platform functions. System messages cannot be replied to.

§ 10 Astrological content, match score and disclaimer

(1) Astro2Match uses date, time and place of birth, questionnaire and profile data to calculate astrology readings, match scores, synastries, composite readings, forecasts, transits and other interpretations.

(2) Astrological content and match scores serve exclusively for entertainment, inspiration and personal orientation. They are not scientifically established statements and no guarantee of love, a relationship, contact or success.

(3) Astro2Match does not owe any particular hit rate, relationship, contact, reply rate, specific partner placement, guarantee of marriage or partnership or lasting compatibility between users.

(4) Content of Astro2Match does not constitute medical, psychological, therapeutic, legal, tax or financial advice. For such questions users should contact appropriate professionals.

§ 11 Backups, technical logs and security

(1) To secure operation, technical backups of the data required for operation may be created. Details of storage locations and internal backup structure are not publicly described for security reasons.

(2) Technical logs, mail-queue logs, security logs and admin logs may be stored for error analysis, security and traceability. Browser data, sessions, technically necessary cookies, local storage entries or service-worker data may be used to provide login status, security, language settings and platform functions. Personal data is only stored as long as required for operation, security, performance of the contract, statutory retention obligations or legitimate interests.

(3) Access to backup and log areas is restricted to administrators and technically protected.

§ 11a DSA notices, complaints and moderation

(1) Users can report problematic content, fake profiles, harassment, illegal content or security problems to Astro2Match via the reporting channels provided.

(2) Astro2Match may review reported content technically or manually and moderate, restrict or remove it within the scope of its legal obligations.

(3) Moderation decisions may be taken in particular in cases of spam, fraud, identity misuse, insults, racist or right-wing extremist content, hate speech, incitement, threats of violence or serious violations of the platform rules.

(4) There is no entitlement to the publication of particular content or to permanent visibility of a profile.

§ 12 Termination, suspension, inactive accounts and account deletion

(1) Paid packages end automatically at the end of the term (§ 4); no cancellation is needed for this. The end of a package does not delete the user account. The user can pause or delete the account itself at any time.

(2) The user can delete their account or request deletion, unless statutory retention obligations, billing data, security interests or obligations to provide evidence stand in the way.

(3) The operator may warn users, restrict functions, suspend accounts temporarily or permanently or delete them if these terms are violated, legal obligations exist or security reasons require it.

(4) Immediate suspension or deletion may be considered in particular in the case of fake profiles, multiple accounts to circumvent suspensions, identity misuse, fraud, payment manipulation, harassment, threats, sexual harassment, spam, automated scraping, circumvention of package limits, racist or right-wing extremist content, hate speech, incitement, threats of violence or serious disruption of platform operation.

(5) In the case of serious or criminally relevant violations the operator may secure content, document events, involve authorities or consider legal action, insofar as legally permitted or required.

(6) When an account is deleted, personal data is deleted unless statutory retention obligations, security interests or billing/evidence obligations stand in the way.

(7) Incomplete and inactive accounts: if a profile is incomplete, Astro2Match may send reminders by e-mail. If an account remains unused for a longer time despite reminders, the user receives a final e-mail announcing the upcoming deletion. The account can be deleted 14 days after this e-mail at the earliest. Deletion is not automatic but takes place after a review by the operator. Anyone who logs in again before then keeps their account.

(8) If the e-mail address is not confirmed after registration, the operator may pause or remove the account after a reminder. This is not automatic either.

§ 12a Rights in case of defects in digital services

(1) Insofar as Astro2Match provides digital content or digital services, the statutory provisions on digital products apply, in particular §§ 327d to 327s of the German Civil Code (BGB).

(2) The digital services must meet the contractually agreed requirements and the statutory requirements regarding functionality, compatibility, accessibility, security and updates.

(3) If a digital service is defective, the user may first demand cure free of charge. Astro2Match will restore the contractual state within a reasonable period and without considerable inconvenience to the user.

(4) If cure is impossible, refused, not carried out within a reasonable period or a defect persists despite an attempt at cure, the user has in particular the following rights in accordance with the statutory provisions: reduction of the agreed price, termination of the contract, damages, or reimbursement of futile expenses.

(5) The statutory limitation periods for claims for defects remain unaffected. For a continuous provision of digital services, § 327j BGB applies in particular.

(6) Astro2Match does not owe any particular contact, matching, placement, communication or relationship success, nor any particular personal result of astrological calculations or readings. The absence of a match, a reply, a personal contact or a desired relationship does not in itself constitute a defect of the digital service.

(7) The above provisions do not limit the user’s statutory rights in case of defects.

§ 13 Liability, availability and maintenance

(1) The operator is liable without limitation for intent, gross negligence and injury to life, body or health. Otherwise the statutory provisions apply.

(2) Uninterrupted availability is not guaranteed. Maintenance, updates, security measures, technical faults, external payment providers, e-mail delivery, server failures or force majeure may lead to restrictions.

(3) Astro2Match gives no guarantee that a particular match score arises, a particular profile is shown, other users reply, contact is made, a relationship develops or astrological assessments are subjectively perceived as accurate.

(4) Users are responsible for content, information, photos, messages and other information they post or send themselves. Astro2Match is not obliged to check all user content in advance but may moderate content within the platform rules and legal obligations.

(5) Decisions that users make on the basis of profile information, messages, match scores, horoscopes, daily readings, forecasts or other evaluations are their own responsibility.

(6) Liability for simple negligence is, to the extent legally permitted, limited to the breach of essential contractual obligations. Further liability only exists where mandatory statutory provisions so provide.

§ 14 Changes to these terms

The operator may change these terms if this is necessary for legal, technical or functional reasons. Material changes will be communicated to users in an appropriate form.

Annex 1 – Right of withdrawal

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the model withdrawal form below, but this is not obligatory.

You can also exercise your right of withdrawal using the withdrawal function provided on our website: https://astro2match.de/index.php?seite=kunde_widerruf. If you use the electronic withdrawal function, we will send you an acknowledgement of receipt on a durable medium (e.g. by e-mail) without delay, containing the content of your declaration and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you in connection with the withdrawn contract without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Start of the service during the withdrawal period

If you requested that Astro2Match begins performing the service during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated your withdrawal, in comparison with the full coverage of the contract.

Early expiry of the right of withdrawal

For a paid service contract, the right of withdrawal expires before the end of the withdrawal period only if Astro2Match has fully performed the service and you, before performance began,

1. expressly agreed that Astro2Match begins performing the service before the end of the withdrawal period, and
2. acknowledged that you lose your right of withdrawal once the contract has been fully performed by Astro2Match.

Merely activating or first using a running Astro2Match package does not automatically cause the right of withdrawal to expire.
